Former prosecuting attorney faces child porn charges
Dick Fox, the now-former prosecuting attorney for the city of Ballwin, in August was arrested and released on an undisclosed amount of bond for charges related to possession of child porn.
According to the indictment from the U.S. Attorney’s office, it states that from Feb. 26, 2008, to March 24, 2009, Fox had images on his computer of a young girl or girls involved in sex acts.
If convicted of possessing child porn, Fox could face up to 10 years in prison.
Ballwin Mayor Tim Pogue said in a press release that the city of Ballwin sent out that the city received and accepted Fox’s resignation following the filing of charges.
Pogue also announced that Fox will be replaced by Keith Cheung, a senior partner with the firm of Curtis, Heinz, Garrett and O’Keefe, P.C. Pogue also said that Provisional Judge Virginia Nye was named Municipal Judge on Sept. 14 and that he intends to nominate local attorney Don Anderson to the Provisional Judge position.
Fox, a long-tenured prosecutor for the city of Ballwin, cited personal reasons for his decision to resign. He was, until recently, also the prosecuting attorney for Clarkson Valley, a back-up municipal judge in Eureka and a private attorney at the firm Curtis, Heinz, Garrett and O'Keefe.
Fox’s biography states that he was the founding partner of Fox, Heller, Gallagher and Finley, a law firm practicing in personal injury, medical malpractice and nursing home negligence.
Fox’s lawyer, Paul D’Agrosa, could not be immediately reached for comment.
